Welcome to Swipe-To-Rent! By using our platform at https://swipetorent.com (“Platform”), you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Introduction

Swipe-To-Rent (“we,” “our,” “us”) is a digital platform that facilitates rental transactions between landlords and tenants. We do not own, manage, or control rental properties or the rental process beyond providing the Platform. By accessing or using the Platform, you (“User”) agree to comply with these Terms.

2. Eligibility

  • Users must be at least 18 years old to create an account and use the Platform.
  • By using the Platform, you confirm that all information you provide is accurate and up-to-date.

3. User Responsibilities

For Landlords:

  • Ensure all property listings are accurate, truthful, and comply with applicable laws.
  • Only list properties you are legally authorized to rent.
  • Handle tenant inquiries, applications, and payment processes promptly.

For Tenants:

  • Provide accurate information when creating a profile or applying for a rental property.
  • Use the Platform solely for legitimate rental inquiries and transactions.
  • Comply with all applicable laws and regulations related to renting.

4. Platform Usage

  • Swipe-To-Rent provides a marketplace to connect landlords and tenants.
  • We do not verify the accuracy of property listings or tenant applications.
  • Users are responsible for conducting their due diligence before entering into a lease or rental agreement.

5. Payments and Escrow Services

  • Payments processed through the Platform are managed by Stripe and First Atlantic Commerce.
  • The Platform may offer escrow services to hold funds securely until all parties agree to release the payment.
  • Escrow terms will be outlined separately and must be agreed upon by both landlords and tenants before use.
  • Any disputes regarding payments will be subject to the dispute resolution process outlined in Section 7.

6. Prohibited Activities

Users may not:

  • Use the Platform for illegal or unauthorized purposes.
  • Provide false or misleading information.
  • Attempt to manipulate, disrupt, or harm the Platform or other users.

7. Dispute Resolution and Mediation Services

  • Swipe-To-Rent is not a party to any rental agreement between landlords and tenants.
  • In the event of a dispute, Users agree to first attempt resolution through the Platform’s mediation services.
  • Mediation services will involve an impartial facilitator provided by Swipe-To-Rent, whose recommendations are non-binding.
  • If mediation fails, disputes must be resolved directly between landlords and tenants or through applicable legal channels.

8. Platform Usage Limitations

  • Swipe-To-Rent does not guarantee uninterrupted or error-free access to the Platform.
  • The Platform may undergo maintenance, updates, or outages.
  • Users acknowledge and agree that availability or performance issues will not entitle them to compensation or damages.

9. Limitation of Liability

  • Swipe-To-Rent is not responsible for the actions, omissions, or agreements made by landlords or tenants.
  • We do not guarantee the accuracy, safety, or legality of listings or tenant applications.
  • To the fullest extent permitted by law, we disclaim all liability for damages arising from the use of the Platform.

10. Termination

  • We may suspend or terminate your account if you violate these Terms or engage in prohibited activities.
  • Users may terminate their account at any time by contacting sales@getpaidsuite.com.

11. Privacy

  • Your use of the Platform is also governed by our Privacy Policy.
  • By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

12. Modifications

  • Swipe-To-Rent reserves the right to modify these Terms at any time.
  • Changes will be effective upon posting to the Platform. Continued use of the Platform indicates acceptance of the updated Terms.

13. Governing Law

  • These Terms are governed by the laws of Jamaica.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of Jamaica.
